1. General provisions
These rules of purchase and sale (hereinafter referred to as the Rules) are established by the Buyer and company H Drop B.V., whose tax identification number in Lithuania 9002344832, VAT code in Lithuania LT100014494316, registered office at Trasmolenlaan 12, 3447 GZ Woerden, Netherlands, tel. +370 5 214 1042
(hereinafter referred to as the Seller) to the Buyer when purchasing goods in the e-shop.
2. Conclusion of the purchase and sale agreement
The purchase and sale agreement between the Buyer and the Seller shall be deemed concluded from the moment when the Buyer, having formed a basket of goods in the e-shop, having indicated the delivery address, having chosen the method of payment, the bank from which the payment will be made and having familiarized himself with these rules, clicks on the button "Confirm order and proceed to payment". The contract shall remain in force until the full performance of the obligations under the rules of this agreement. Each contract concluded between the Buyer and the Seller is stored in the www.hdrop.lt e-shop.
3. Buyer's rights and obligations
3.1. In accordance with these Rules and legal acts of the Republic of Lithuania, e-shop Buyers are:
3.1.1. active natural persons, i.e. persons who have reached the age of majority, whose capacity is not restricted by court order;
3.1.2. minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, unless they independently dispose of their income;
3.1.3. legal entities;
3.1.4. authorized representatives of all the above mentioned persons.
3.2. The Buyer (consumer) has the right to withdraw from the contract of purchase and sale of goods with the Seller by notifying the Seller in writing within 14 working days from the date of delivery of the goods, in accordance with order No. 258 of the Minister of Economy of the Republic of Lithuania of 17 August 2001 "On the approval of the rules for the sale of goods and provision of services when contracts are concluded using means of communication".
3.3. The Buyer must accept the ordered goods and pay the price of the goods and their delivery.
3.4. If the data provided in the Buyer's registration form changes, the Buyer must immediately update them.
3.5. The goods selected by the Buyer are reserved and the Seller undertakes to execute the purchase and sale agreement only after the Seller receives a notification from the Buyer's bank about payment for the selected goods. The Buyer must confirm the payment order no later than within 24 hours from the click of the "Confirm order and proceed to payment" button. If the payment order is not confirmed within this time limit, the Seller has the right to assume that the Buyer has abandoned the purchase and sale agreement.
3.6. In order to return a quality product, the Buyer must contact the Seller by e-mail: pagalba@hdrop.lt. The returned goods must be undamaged in the original manufacturer's packaging. When returning an item, a document confirming the payment of the item must be attached. The costs of returning the goods shall be borne by the Buyer.
3.7. The Buyer must comply with other requirements established in the Rules and legal acts of the Republic of Lithuania.
4. Seller's rights and obligations
4.1. If the Buyer attempts to impair the operation or stable operation of the e-shop, the Seller may, without prior notice, restrict, suspend (terminate) his/her access to the e-shop.
4.2. The Seller has the right to temporarily or indefinitely terminate the activities of the e-shop without a separate notice.
4.3. The Seller has other rights provided for in the Rules and legal acts of the Republic of Lithuania.
4.4. The Seller must enable the Buyer to properly use the services provided by the e-shop.
4.5. The Seller must arrange the delivery of the goods ordered by the Buyer to the address indicated by the Buyer.
4.6. The Seller, in case of important circumstances, unable to deliver the ordered product to the Buyer, undertakes to offer the Buyer an analogous product, and if the Buyer refuses to accept the analogue of the product, return the money paid by the Buyer within 7 working days, if the Buyer has made a prepayment.
4.7. If the purchased product did not meet the quality requirements, the seller undertakes to replace the item of inadequate quality with a good quality product, reduce the price of the goods accordingly or return the money paid for the goods and their delivery within 7 days from the submission of the application.
4.8.Upon termination of the contract, the Seller undertakes to return the money for the returned tidy item within 7 days.
5. Delivery of goods
5.1. The Seller delivers the ordered goods within 2 working days, during the festive or emergency period within 5 working days from the receipt of payment for the goods through the courier service chosen by the Buyer.
5.2. Upon receipt of the shipment of goods, the Buyer together with the carrier must check that the condition of the shipment has not been damaged. If the shipment of goods has been damaged, the Buyer must mark it in the transfer-acceptance document (consignment note). Upon acceptance of the goods and signing the transfer-acceptance document (consignment note) without notes, it is confirmed that the shipment of goods has not been damaged and properly delivered.
6. Return of goods
6.1. The return of purchased goods in the e-shop takes place in accordance with Order No. 258 of the Minister of Economy of the Republic of Lithuania of 17 August 2001 "On the Approval of the Rules of Sale of Goods and Provision of Services when Contracts are Concluded using Means of Communication" and Order No. 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001 "On the Approval of the Rules for Returning and Replacing Items".
6.2. The Seller replaces or accepts the goods that the Buyer wishes to return with the undamaged packaging and the proving purchase document within 14 calendar days from the date of delivery of the goods:
6.2.1. H Drop unit at J. Basanavičiaus str. 26, Vilnius.
6.2.2. Via DPD courier or Omniva post office at J. Basanavičiaus str. 26, LT-03224 Vilnius (recipient - H Drop). The cost of delivering the goods is non-refundable. The Buyer returns the disliked goods by his own transport or pays the return costs.
6.3. If the Buyer decides to terminate the contract and informs the Seller, the Buyer loses the right to use the product from the date of dispatch of the notice. The date and time of sending the notice shall be determined by the time of dispatch of the Buyer's notice. If it is established that the product has been consumed (used) after the notice has been sent, the Seller has the right to refuse to terminate the contract.
6.4. The Buyer may exercise the right of return of the goods if the product has not been used, the original packaging of the product is intact and has not lost its commercial appearance. Returned items must be fully completed. The Buyer is responsible for the complete completion and packaging of the item. If the goods are not complete and properly packed, the Seller or his representative may refuse to accept the returned goods. Changes in the appearance of the product or its packaging that were necessary to inspect the item cannot be considered as fundamental changes in the appearance of the item.
6.5. If the purchased product did not meet the quality requirements, the Seller undertakes to replace the item of inadequate quality with a good quality product, reduce the price of the product accordingly or return the money paid for the goods and their delivery within 7 working days from the submission of the application. The goods must be returned in the original packaging of the goods and the consignment. The Buyer must also provide the original invoice for the goods and the completed and signed return form, which must state the reason for returning the goods.
7. Responsibility
7.1. The Buyer is responsible for the correctness of the data provided in the registration form. The Buyer assumes responsibility for the consequences arising from the incorrectness or inaccuracy of the data provided in the registration form.
7.2. The parties shall be liable for violation of the purchase and sale agreement concluded using the e-shop in accordance with the procedure established by the legal acts of the Republic of Lithuania.
7.3. The Seller shall not be liable for the information provided on the websites of other companies, even if the Buyer enters these websites through the links in the Seller's e-shop.
7.4. In case of damage, the guilty party shall compensate the other party for the losses incurred.
8. Sending information
8.1. The Seller sends all notifications to the e-mail address provided in the Buyer's registration form.
8.2. The Buyer sends all notices and questions to the addresses specified in the "Contacts" section of the Seller's e-shop.
9. Final provisions
All disagreements arising from the enforcement of these rules shall be settled by negotiation. In case of failure to reach an agreement, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
